These Terms of Service ("Terms") are a binding agreement between you and HeroTracker ("HeroTracker," "we," "us") governing your use of the HeroTracker app, its web version, and this website (together, the "Service"). Please read them together with our Privacy Policy and Consumer Health Data Privacy Policy.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
HeroTracker is a personal health and wellness tracking tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Content, insights, and any AI output are for general informational purposes only and are not a substitute for professional medical judgment. Always consult a qualified clinician before making health decisions. Never disregard or delay seeking medical advice because of something in the Service. In an emergency, call your local emergency number (in the US, 911) or the 988 Suicide & Crisis Lifeline. You are solely responsible for decisions you make based on the Service.
You must be at least 13 years old (or the higher digital-consent age in your country in the EEA) to use the Service. Certain optional features — including connecting an external AI assistant — require you to be at least 18. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
You are responsible for keeping your login credentials secure and for activity under your account. Tell us promptly at support@herotracker.co if you suspect unauthorized use.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own personal, non-commercial use. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works of the Service except as permitted by law.
The health information and other content you record is yours. You grant us a limited license to host, process, and display it solely to operate and provide the Service to you (including sync and any features you enable), as described in our Privacy Policy. You can export or permanently delete your data at any time from within the app. You are responsible for the content you enter and for having the right to enter it.
You agree not to:
Optional AI features, and any external AI assistant you choose to connect, require your explicit consent and rely on third-party providers that operate under their own terms and privacy policies. AI output is generated automatically, may be inaccurate or incomplete, is not medical advice, and carries no warranty. You are responsible for how you use it.
The Service — including its software, design, logos, and content we provide (excluding your data) — is owned by HeroTracker and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding. All rights not expressly granted are reserved.
If you obtained the app through the Apple App Store or Google Play, your use is also subject to that store's terms. Where the app is downloaded from the Apple App Store, you acknowledge that these Terms are between you and HeroTracker (not Apple); that Apple has no obligation to provide support or maintenance for the app; that Apple is not responsible for any product warranties or claims; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. If you obtained the app from Google Play, your use is also subject to Google Play's Terms of Service, and you acknowledge that these Terms are between you and HeroTracker (not Google), and that Google is not responsible for the app, its content, or support for it.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will never be lost. You are responsible for keeping your own copies (e.g., via Export).
To the maximum extent permitted by law, HeroTracker and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or US$50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless HeroTracker and its operators from claims, damages, and reasonable expenses (including legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. On termination, the license in Section 5 ends; sections that by their nature should survive (Sections 6, 9, 11–13, 15, and 17) survive.
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Before filing any claim, you agree to first contact us at support@herotracker.co and try in good faith to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be subject to the courts located in Ontario, Canada, and you consent to their jurisdiction — except that either party may seek injunctive relief for intellectual-property or unauthorized-access matters, and you may always pursue an eligible claim in the small-claims court of your own home jurisdiction. Nothing here waives any non-waivable right or protection you have under the consumer-protection or privacy laws of your home jurisdiction (for example, a California resident's rights under California law).
If you believe content in the Service infringes your copyright, send a notice with the required details to support@herotracker.co and we will respond as required by applicable law.
If any provision is found unenforceable, the rest remain in effect (severability). These Terms, with the policies referenced, are the entire agreement between you and us about the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure).
We may update these Terms; the current version is posted here with its effective date, and material changes will be surfaced in the app. Continued use after changes take effect means you accept the updated Terms.
